Mayor Gergely Karácsony did not comply with the court's verdict and did not pay the HUF 500,000 fine imposed on him for the unauthorized use of István Tiborcz's name, Pesti Srácok wrote. István Tiborcz wants to use the damages for charitable purposes.

In its decision of June 7, 2021, the Capital City Court of Justice ruled that the reigning mayor of Budapest committed a violation of the law when he used the term "Tiborcz-adó" in his election campaign with the unauthorized use of István Tiborcz's name, the portal reminded .

The court prohibited Gergely Karácsony from further violations of the law and obliged him to publicly apologize and pay damages. István Tiborcz wants to use the damages for charitable purposes.

The mayor appealed to the City Hall with a review request in the case, but according to the main rule, this does not exempt him from paying the compensation fee. According to the Court's procedural rules, the submission of a request for review does not have the effect of postponing the execution of the decision, although in special cases suspension of enforceability can be requested. However, this must be applied for separately, and the Court considers it based on strict criteria.

According to the final judgment, Karácsony should have followed István Tiborcz by publishing a public apology notice with the following content by Thursday:

"During my campaign, I seriously violated István Tiborcz's right to use his name on social media on several occasions, when I named the tax I wanted to introduce after him. I apologize for all of this."

In addition, you must also delete the infringing content that violated István Tiborcz's personal rights. In addition, the court ruled that Karácsony must also pay HUF 500,000 damages to the contractor, which Tiborcz offered to the Bókay Children's Clinic, within 15 days of receiving the verdict.

However, Gergely Karácsony has not fulfilled any of his obligations so far.
