I asked the Commissioner of Fundamental Rights several times whether, in his opinion, the principle of the rule of law does not conflict with the fact that those who do not have a protection card have to pay HUF 30,000 in order to have an elective intervention performed. Recently, to my question, he revealed that he had launched an investigation, and now it has also been revealed in connection with what specific case he investigated the government's unconstitutional practice. A 4-year-old child and his accompanying parent were asked to take a paid PCR and antigen test in a medical institution.

The question of the cost of PCR tests must be regulated in a government decree

In this matter, the government's position was reached, according to which the issue of the cost of PCR tests should be regulated in a government decree. magyarhirlap.hu reported . The Government Information Center writes, among other things:

According to the government's point of view, since all Hungarian citizens can receive the vaccine against the coronavirus free of charge, there is no reason for the tax-paying Hungarian people to cover the costs of the PCR test for those patients who are about to undergo postponed surgery, and for whom the test is necessary solely because of their own free will, they did not use the opportunity to be vaccinated.

According to the government, contrary to the ombudsman's opinion, the opposite regulation would be constitutionally objectionable.

At the same time, we agree with the Commissioner of Fundamental Rights that the issue should be regulated in a government decree, which the government will do this week.

The government regulation provides a solution to the case of the complainant in the ombudsman's petition, as it will include that the PCR test is also available free of charge to those who accompany their small child in need of surgery to the hospital and did not take advantage of the opportunity to be vaccinated.

And after the facts:

I would add to Bernadett Szél's objections that this case does not violate my rule of law and legal certainty, but my human dignity and especially my right to equal treatment is very much violated, as she stands by those who for some reason did not vaccinate themselves.

Because there is nothing wrong with someone being anti-vaccination, as was the rainbow left-liberal side in the beginning. But let's not forget that there are also those who said no out of hatred for Dafke and Fidesz, and there are even those who believe that the vaccine is implanting a chip in people.

There must have been those who, through no fault of their own, could not vaccinate themselves. Obviously, there were and are real grievances that need to be corrected, but I think it is unfair that all those who are in the majority should pay the test against a minority. Although it is trendy today that the screaming minority wants to prevail over the majority, this is already an exaggeration.

It is not always necessary to follow the American example, where now in some states they want to order the wearing of masks again in order to protect those who refused to be vaccinated.

That is why I recommend that, based on the principles of the rule of law, legal security, human dignity and equal treatment, you and those who agree with you, collect the money to pay the price of PCR tests for those who demand the free test.
