It was time to!

With its first-instance judgment handed down on February 9, 2022, the Metropolitan Court ordered an LGBTQ person with US-Greek citizenship living in our country to pay damages in the amount of two million forints plus interest, as well as nearly one million in court costs, for the 2014 Pride in Budapest, which promotes "otherness". on July 5, in order to protect normality, peacefully protesting with his companions, holding a picture of the Virgin Mary, Dr. To the detriment of Imre Téglásy, the president of the Alfa Association, he committed the offense of indecent assault, as determined by a criminal court. Dr. Attorney Tamás Gaudi-Nagy, executive director of the National Legal Protection Service (www.njsz.hu), has been providing it for four years.

In the recording, Dr. The plaintiff Imre Téglásy and his legal representative appreciate the hugely important verdict, which will hopefully have a sufficient social protection and mobilizing effect with regard to the child protection referendum in April. The case is a typical example of how intolerant those who act in the name of LGBTQ and who demand acceptance can be towards those who defend normality, how they tend not to respect the human dignity of those who stand for traditional values, to think that they are above the law and the consequences of their actions but not to undertake.

In the civil lawsuit initiated in order to compensate the violation of personal rights caused by the crime with damages, as a result of the evidence conducted, the court stated that the perpetrator violated Dr. Imre Téglásy's right to his sexual integrity and thus his right to his human dignity, and is therefore obliged to compensate the non-pecuniary disadvantage caused.

Among other things, the justification of the judgment states that "behavior that violates the right to personality, thus the means of public disputes, cannot be what the defendant demonstrated, and the court did not consider the fact that the plaintiff felt humiliated and dishonored as a result of this defendant's behavior to be proven separately. " The court also ruled - refuting the offender's defense that he was only reacting to what he believed to be intolerant behavior of the wrongdoer - that "in no way can the counter-opinions commensurate with the plaintiff's opinion be called the defendant's behavior" and "the court did not find any intolerance in the plaintiff's behavior, because if it is not intolerance on the part of the defendant and the other persons participating in the demonstration, it is not intolerance to demonstrate one's own values in front of the country and the world, then the display of the same cannot be classified as intolerance on the part of the plaintiff and his community."

The court determined the amount of the damages - keeping in mind the preventive and reparative goals - in an amount lower than the amount requested in the claim, but the verdict is acceptable to the injured party as a whole.

The judgment is not yet final, but since in the case of an appeal in this type of case, the second instance does not hold a hearing and decides on the basis of documents, there is a real chance that this precedential judgment will become final.

According to the facts, a person from among the Pride marchers defiantly walked into the peacefully protesting counter-demonstrators, although the police separated them with cordons, who was called Dr. As director Imre Téglásy asked her to leave, whereupon the provocateur began to hug her, then grope her in an indecent manner, and finally groped her breast. The man who behaved scandalously was restrained by the police and other counter-protesters. The perpetrator then left by posing and waving Nazi arms, addressing the victim with the statement "God is with you my love".

In the criminal proceedings lasting six years - which dr. It was started due to a complaint filed by Imre Téglásy for defamation (they searched for the perpetrator for three years) - although the prosecution requested in vain to charge him with the crime of violence against a member of the community, which is much more suitable for classifying the act, the Central District Court of Pest found the perpetrator guilty only for the offense of indecent assault, for this reason, he was placed on probation for two years, and the victim's civil rights claim was directed to other legal channels. In the second instance, the time of the probation measure was reduced to one year, but it was ruled that the perpetrator violated dr. Imre Téglásy's right to sexual integrity and human dignity. In the criminal proceedings, one of the prominent lawyers of the Hungarian Helsinki Committee, dr. Tamás Fazekas defended the perpetrator. After that, the newly introduced type of expedited trial, available to victims, started in the fall of 2020, in which the current verdict was handed down barely a year later. The perpetrator showed no remorse during the proceedings and repeatedly expressed himself as a Nazi in an offensive manner against traditional values and their representatives.
