Csaba Czeglédy's trial was supposed to be heard in the capital first, but the Pest Central District Court sent the case to Szombathely. However, the judges there announced bias, so the proceedings have now been transferred to Veszprém.
Every court is trying to postpone the hearing of the devil's advocate trial - at least that is what can be inferred from the fact that although the prosecution filed charges in the case last October, the documents are already at the third court. As previously reported by Mandiner, in October of last year, the Metropolitan Prosecutor's Office brought charges against DK lawyer Csaba Czeglédy and his partner for nine counts of misuse of special personal data.
According to the prosecutor's office, the Czeglédys were the ones who made public the sexually explicit recordings of Zsolt Borkai, the former Fidesz mayor of Győr, shortly before the 2019 municipal elections. Based on the indictment, the defendants caused a significant harm to the interests of those involved by publishing photographs and video recordings containing special personal data and with sexual content. The prosecutor's office suggested that the court should impose a fine on the lawyer, and a suspended prison sentence on his accomplice, who is a repeat offender, by omitting a trial.
The prosecution filed charges against the Czeglédys at the Central District Court in Pest, but the PKKB stated that it would not make a decision with a criminal sentence, as in their opinion the case cannot be judged that way.
All of this meant that a preparatory meeting would have been held in the matter, but this ultimately did not take place. It turned out that the PKKB had delegated the case to the Szombathely District Court in the absence of jurisdiction
Czeglédy appealed the decision, but the second-instance court found that the transfer was legal and justified.
However, as the General Prosecutor's Office has just learned, the judges of the Mandiner, the Szombathely District Court and the Szombathely Court of Appeal (as a court of second instance) reported bias on the grounds that they had a regular working relationship with Czeglédy - as a lawyer - in the past.
For this reason, the Győr Jury, which decided on the place of the proceedings, excluded the Szombathely District Court and the Szombathely District Court from hearing the case, appointed the Veszprém District Court to conduct the first-instance proceedings, and the Veszprém District Court for the possible second-instance proceedings. At the same time, the prosecution will still be handled by the Chief Prosecutor's Office of the Capital City, said Bettina Bagoly.
In response to the question, the spokesperson said that an investigation was underway based on a report filed by Justice Minister Judit Varga regarding the devil's advocate for the offense of defamation committed in public.
To the question of whether this case could possibly be connected to the main proceedings later, he replied: according to the Criminal Procedure Act, the court can only combine cases pending in the same procedural branch - on the basis of possible material or personal connections or other expediency reasons. therefore, the question is not current with regard to the cases in question.
