Momentum wants to sabotage the effective functioning of the legislature through petty political games, while there is a war going on in Hungary's neighborhood - junior constitutional lawyer Zoltán Lomnici emphasized to Magyar Hírlap.

XXXVI of 2012 on the Parliament. pursuant to the law, until the oath is taken and the oath document is signed, the representative cannot participate in the meetings of the parliament and parliamentary committees, cannot exercise his right to consult and vote, cannot submit motions, cannot be elected to the positions of the Parliament or to a committee, cannot participate in the formation of a representative group - stated Zoltán Lomnici Jr. regarding the fact that several elected left-wing politicians announced that they would not attend the founding session of the parliament.

Lomnici explained: during the inaugural session, all the representatives who receive a parliamentary mandate take their oath in order to start parliamentary work as soon as possible. Although the act can be replaced later, it must be seen that Momentum intends to sabotage the effective functioning of the legislature through petty political games, while there is a war in Hungary's neighborhood.

Such behavior, which is unworthy of a parliamentary party, is morally and legally unacceptable, since it is the duty of every representative to proactively participate in the work of the parliament and promote its effective functioning - emphasized the constitutional lawyer, who also touched on the fact that modern constitutional states have preserved the tradition of that the person holding the public office makes a solemn declaration and oath before starting the official relationship.

In Germany, the current chancellor swears that he will dedicate his work to the German nation with all his strength, and the first man of the Polish government believes that he wants to see the fight for the good of the citizens as his primary obligation. The Basic Law of Hungary mentions the obligation to take an oath in two places: for the President of the Republic and for members of the government. In addition, the Act on the National Assembly requires the taking of an oath for other officials, such as members of the National Assembly, and the institution of the oath has serious public law traditions, as Act I of 1946 already required its taking.

As stated in the Basic Law of Hungary, the Parliament is the main representative body of our country, and all members of the Parliament bear joint responsibility for serving Hungary, the Hungarian nation and the public good, ensuring the inviolability of the proper exercise of representative rights and the functioning of the Parliament worthy of its public law status, continued Lomnici. He pointed out: the essence of the oath of office is that the person taking the oath declares that he performs his office not only legally, but also with loyalty, conscientiousness and effort.

The common element of the declarations is that they stipulate the recognition and protection of the constitution and the constitutional institutional system, and enforce the requirement of loyalty to the state and respect for the constitutional order. It follows from this that the persons acting on behalf of the state must respect the institutional frameworks, which - following the democratic decisions of the political community - are laid down in the constitution.

Taking the oath of office of the representative - as stated in several decisions of the Constitutional Court and confirmed by the Act on the Parliament - is a valid requirement for the representative to take office: "Until the representative takes the oath and signs the oath document - with the exception of performing the tasks associated with the holding of the inaugural session - can participate in the work of the Parliament."
