The constitutional lawyer suffering from ALS explained on his social media page that at the beginning of January, he appealed to the former president of the Republic, Katalin Novák, to grant clemency to those who help those suffering from an incurable, fatal disease to leave. Dániel Karsai, who suffers from an incurable disease, added that he will also submit his proposal to the next head of state.
In his latest post, the constitutional lawyer suffering from an incurable disease discusses the issue of presidential pardons. Dániel Karsai wrote that, for him, the piquancy of the matter is that he approached Katalin Novák on exactly this topic in January.
He added that life washed away the matter for known reasons, but at the same time, according to him, his suggestion regarding end-of-life decisions is workable, so he will also raise it with the next president of the republic.
The constitutional lawyer believes that his initiative may also be suitable for "restoring the battered reputation" of the power of pardon. Dániel Karsai stated that:
I suggested that the (former) President of the Republic publicly undertakes to grant clemency to those who help those who suffer from an incurable, fatal disease and are exposed to unbearable physical and mental suffering to leave. In Hungarian, I wanted to obtain exemption from the criminal consequences of complicity in suicide through this special route. Strictly for patients and their caregivers who are exposed to unbearable and intractable suffering.
He then continued, "so that the presidential pardon could not even accidentally be used abusively, I also suggested that the President of the Republic be assisted by a committee in such pardon cases."
"Members of the committee would be doctors, psychiatrists, and criminal law experts. The list can be continued and refined. This committee would take a position for the President of the Republic that it was really justified to participate in the suicide in order to end the suffering of the person concerned, and that it took place in accordance with the will of the person concerned"
Dániel Karsai wrote.
The National Election Commission (NVB) rejected the initiative of Péter Karsai, the younger brother of Dániel Karsai, who suffers from ALS, which would have put the issue of euthanasia to a referendum.
A few days later, the constitutional lawyer announced that
"the position of the National Electoral Commission is untenable from a constitutional point of view", so he turns to the Curia.
Since then, it has become clear that Dániel Karsai will not withdraw from the referendum initiative on euthanasia and will submit an application to the National Election Commission.
