The court rejected the review request of the Median leader, Endre Hann, in which he proposed that the Court set aside the legally binding, second-instance verdict and uphold the first-instance court's verdict. With this decision, the court has now declared at the highest level of the domestic justice system that the distributor of the movie Elkxrtuk, Mega Film Kiadó Kft., did not violate the rights of Hann Endre to his reputation.
Among the antecedents of the decision Magyar Nemzet recalls that in connection with the movie Elkxrtuk, which was screened with enormous interest and dealt with the bloody events of 2006 and the leaking of Ferenc Gyurcsány's Ószöd speech, Hann Endre claimed that the creators portrayed him in a bad light in the film. He is portrayed precisely as the head of the Median Public Opinion and Market Research Institute, who manipulates data for the benefit of the ruling parties, and with his various advice contributes to the development of a crisis that culminates in street fights. For the sake of accuracy, let us add that Endre Hann claims that the character named Endre in the film - and the figure who committed the above - can be identified with him.
According to the first-instance judgment of the Metropolitan Court, Megafilm Kft. violated the plaintiff's personal rights to his good reputation. For this reason, he must express his regret on his website, and he also ordered the defendant to pay HUF 1.5 million in damages and HUF 500,000 in court costs. However, a different decision was made at the second instance. The court found that the first-instance decision was incorrect in several respects: the film did not violate Hann Endre's personal rights.
The offended pollster first demanded three million forints and an apology as part of an out-of-court settlement, but in the lawsuit he initiated he also called for the film to be banned.
In the third instance, the Kúria ruled in favor of the production company Megafilm Kft. in the lawsuit brought by Hann Endre over the film Elkxrtuk

the creative and artistic freedom of the film Elkxrtuk is stronger than the personal rights and protection of the plaintiff.
