The NMHH also issued a statement according to which the court rejected the radio's claim in its entirety and emphasized that the media council made its decision legally in all respects.

They reminded: Klubrádió challenged in court the decision of the media council on March 10, in which it closed Budapest's 92.9 MHz radio frequency tender process without a winner, after the offer of Klubrádió Zrt., the only remaining bidder in the process, was also found to be invalid. .

They added, the Capital Court highlighted in its judgment on Thursday: the media council correctly established that Klubrádió's application contains serious invalidity errors, and that the economic operation of the radio does not comply with the legal and application requirements.

It was written that during the oral judgment the court pointed out that Klubrádió's program schedule is incomplete and contradictory, so it does not meet the tender requirements, in view of which the tender offer could not be evaluated on its merits.

"Based on all of this, the media council had no choice but to declare Klubrádió's application invalid," they said in the announcement.

According to the NMHH, when announcing the verdict, it was also emphasized: the media council also correctly referred to the fact that there is no legal possibility to fill in the gaps in the case of factual errors in the tender offer. That would have violated the purity of the competition, because Klubrádio would essentially have had to submit a new program plan, they added.

It was also reported that the tribunal also shared the media council's position on the radio's business and financial plan, emphasizing that ensuring legal operation is of fundamental importance for all economic companies, but this was not fully fulfilled in the case of Klubrádió.

The court also agreed with the position of the media council - they added - that this is not just a formal issue, but a substantive condition that the applicant should have fulfilled when submitting the offer.

According to the court's opinion, the media council correctly came to the conclusion from the submitted business plan and balance sheet data that the fulfillment of the tender objectives cannot be expected from the company that "actually does not meet the requirements of legal operation", and did not eliminate this unlawful state verifiably, they wrote.

The verdict is not legally binding and can be appealed within 15 days of its announcement, says the NMHH announcement.
