We have value disputes with the European Union, even though the law is meant to protect value - the Minister of Justice stated on Thursday, at the 15th Hungarian Legal Assembly in Balatonfüred - Magyar Hírlap reported.

Regarding the rule of law report, the head of the ministry said: there are methodological shortcomings, one-sided references, double standards and political motivation behind it.

He drew attention to the fact that, while there used to be a dialogue on the rule of law, where the differences between the member states were taken into account, this has now been superseded by the "newest practice", that the European Commission prepares its report with reference to the reports of NGOs, without taking into account the opinions of the member states.

The Minister of Justice also said in his presentation entitled Public Law Debates before European Forums: the rule of law reports are good for getting to know the rule of law system of other member states, and based on these it is clear that the "Hungarian rule of law is neither better nor worse than any rule of law in the world”.

According to Judit Varga's point of view, since 2018, Hungary has been hit by an ideologically based attack, which "doesn't know where it will lead", but "they are professionally prepared".

He said that Hungary is in the middle of Europe in terms of the number of infringement proceedings initiated due to content problems, and in the first third of those initiated due to the transposition of EU law.

The minister expressed his joy at the fact that Hungarian judges are the most active in the EU in submitting requests for preliminary rulings: between 2016 and 2020, Hungarian courts submitted 104 such requests, while Slovaks submitted 34, Swedish 37, and Greek 20 such requests. He put it this way: the Hungarian government allegedly intimidates Hungarian judges, they don't dare to turn to the European Court of Justice, while "here is the splendid proof that they turn to them very often".

In relation to the Minority SafePack case, he mentioned that more than one million signatures had been collected across the EU for a much more effective enforcement of minority rights, but the European Commission – contrary to the EU treaties – did not deal with the issue. He indicated that a court decision on the matter is expected in 2022, and Hungary intervened in the proceedings alongside the organizers.

Speaking about the child protection law, Judit Varga said: the law on the "protection of minors from public information" has been in force in Lithuania since July 2009, which - as she added - is now part of the European legal system and protects family values, defines that marriage is a it is created by the free will of a man and a woman. These have been applied by Lithuanian judges since then, so there are examples of such regulations in the EU. Hungary is still being attacked for this , he noted.
