The European Commission (EC) summons Hungary to the EU court and requests the imposition of a flat-rate financial sanction and a daily fine for Hungary's failure to comply with the court ruling of last December related to the EU rules on asylum and return.
The European Commission is asking the EU court to impose a fine on Hungary. As recently as last December, the Court of Justice of the European Union ruled that the Hungarian legislation on the rules and practices for the transit zones on the Serbian-Hungarian border are contrary to EU law. At the time, the Luxembourg panel found that Hungary had not fully fulfilled its obligation to provide access to the asylum procedure. Those non-EU citizens who wanted to use the procedure at the Serbian-Hungarian border had to face the fact that it was almost impossible to submit their application, the court said in its ruling at the time. In particular, the panel found a violation of the provisions of the directive on asylum procedures, return and reception.
According to the committee, the new Luxembourg procedure is necessary because Hungary has not dealt with several elements of the judgment until now. It did not take the necessary measures to ensure effective access to the asylum procedure, nor did it specify the conditions that apply to the right to stay in the area in the event of an appeal submitted within the asylum procedure, in the event that there is no crisis situation caused by mass immigration.
In response to the European Commission's decision, the Government Information Center (KTK) announced:
Brussels is not resting, it wants another trial and punishment due to the Hungarian immigration rules. The KTK also drew attention to the fact that "pressure is being exerted on Hungary for the sixth year, because we protect the border and say no to the resettlement of migrants".
On the basis of concerns regarding compatibility with EU law, the European Commission launched infringement proceedings against Hungary in December 2015 under the leadership of former Commission President Jean-Claude Juncker, which ended with the judgment of the European Court of Justice on December 17, 2020. According to Hungary, Hungarian regulations and practice comply with EU and international law. On February 25, 2021, the government submitted the case to the Constitutional Court, indicating that it cannot comply with the provisions of the EU court until its verdict.
Last summer, the Hungarian government closed the transit zones and developed a new procedure in order to alleviate migration pressure. According to this, the request for asylum can be submitted at a Hungarian embassy outside the EU. The Hungarian authorities will decide on this whether it is suitable to start an asylum procedure on this basis. If so, the person concerned will receive a one-time entry permit to Hungary for the duration of the procedure.
The European Commission believes that this procedure violates the Directive on Asylum Procedures, as it excludes the possibility for persons staying on Hungarian territory, including at the border, to apply for international protection, which is why the board has initiated infringement proceedings.
