The Chief Counsel of the Court of Justice of the European Union proposed that the board reject the Hungarian and Polish lawsuit filed for the annulment of the so-called budget conditionality decree, announced Judit Varga in her post published on social media, who also warned: this is not yet a verdict, just an opinion.
Before there are tears of joy in the eyes of the Brussels elite and the left-liberal press, I would like to note quietly: this is only a proposal, a verdict is expected only at the end of the year, at the beginning of next year - emphasized the head of the Ministry of Justice.
Judit Varga also pointed out:
the general counsel's motion ignores that the conditionality decree suffers from a number of obvious legal errors, which individually justify its annulment: its legal basis is flawed, it circumvents contracts, and it violates the basic requirements of the rule of law, especially the principles of legal certainty and normative clarity.
"The Hungarian government stands by its position and trusts that the Court of Justice will base its judgment solely on legal arguments and common sense, will not follow the erroneous reasoning of the Advocate General, and will instead annul the decree or call on the EU legislator to amend it"
