According to the head of the Center for Fundamental Rights, based on the procedural rules, it is conceivable that voters could vote on this issue in the spring.

Miklós Szánthó emphasized that the Constitutional Court (AB) made the only possible and correct decision when it annulled the previous decision of the Court and approved the fifth question of the child protection referendum. The director of the Center for Fundamental Rights emphasized that the decision of the constitutional judges is in line with common sense and the constitutional protection of the child's right to self-identity according to their birth sex.

According to the board's decision, a referendum can be held on whether sex reassignment surgeries should be available for children.

On the other hand, the council led by András Kovács Kúria previously made an ideologically motivated decision when it blocked the question of banning the availability of gender-changing treatments, among other things, on the absurd grounds that the ban would limit the exercise of the minor's fundamental rights, right to self-determination and right to bodily integrity, the expert noted. . Szánthó noted that the AB's decision is important not only from a legal and moral point of view, but also from a political point of view:

even if very narrowly, but in principle based on the rules of procedure, it is conceivable that voters could vote on this issue together with the other four already approved issues, even in the spring, at the same time as the parliamentary elections.

According to the decision of the Constitutional Court, it is therefore possible to hold a referendum on whether sex reassignment surgeries should be available for children. As is well known, on November 30, the Parliament ordered a national referendum on the four questions that the highest judicial forum upheld, but at the same time decided that on the question "Do you support gender reassignment treatments being available to minors as well?" ?”, it is not possible to initiate a referendum.

Viktor Orbán announced on July 21 that the government will launch a referendum on child protection. The prime minister stated that Brussels attacked Hungary because of the child protection law, because they do not accept that we resist LGBTQ propaganda.

The future of our children is at stake, so we cannot give in on this issue - emphasized the prime minister. The purpose of the referendum is to strengthen the rights of parents in the upbringing of children, and to take stricter action against pedophile criminals, and to put an end to the practice of LGBTQ organizations giving lectures on sexual topics to children under the heading of sensitization.
