Everyone in Germany will be able to freely change their gender and first name from the age of 14, according to a draft law in the making that was unveiled on Thursday.

Federal Minister of Justice Marco Buschmann and Minister of Family, Seniors, Women and Youth Lisa Paus highlighted in a joint briefing in Berlin: all three governing parties - the Social Democrats (SPD), the Greens and the liberal Free Democratic Party (FDP) - agree that the the legislation on the status of transsexuals must be replaced by a new law.

According to the intention of the coalition, the so-called Self-Determination Act will replace the old law, which many experts consider discriminatory and outdated.

According to the basic principles developed during consultations between the governing parties and the relevant ministries, the new legislation must stipulate that everyone from the age of 14 can independently and freely determine their gender and first name through a simple registry office procedure, without any medical examination or expert opinion.

Marco Buschmann underlined that although it is statistically rare, it is very "normal that there are people whose sexual identity differs from their biological sex".

These people "we have been treated as patients for many, many decades, as if something was wrong with them", but this "pathologizing" is a wrong approach that must be broken with, since "every person deserves to be treated with respect", explained the FDP- and politician.

He emphasized that the aim of the coalition is not to "overturn" social relations, but to fulfill the central promise of the constitution, the German Basic Law, according to which everyone has equal freedom and equal dignity.

Lisa Paus underlined that society is ahead of legislation in many matters. With the Self-Determination Act, such a delay is introduced, because the legislation will not only improve the lives of transgender people, but also "recognize the diversity of genders".

The politician of the Greens added: it must be ensured that the protection of the private sphere also extends to the change of gender and first name, because the new law cannot mean "forced disclosure". That is why they also state that a fine must be imposed if any authority, organization or private individual discloses that they have changed their gender or first name without their consent.

The minister also spoke about how the previous law introduced in 1980 caused a lot of suffering, including forcing people to divorce or undergo major surgery just to be able to recognize their gender identity.

"It is time to apologize and provide reparations for these injustices," said the German minister for families, the elderly, women and youth.

The country's leading child protection organization, the German Child Protection League (DKSB), welcomed the government's initiative. Daniel Grein , the managing director of the DKSB, pointed out that uncertainty about their own gender is a "heavy psychological burden for the children and adolescents concerned". On the other hand, the new legislation can provide even 14-year-olds with the opportunity to change their gender and first name in consultation with their parents at the registry office.

“It would take a lot of weight off the shoulders of young people,” said Daniel Grein.
