As of November 1, the government may occasionally request the extension of the state of emergency beyond thirty days from the National Assembly for a maximum of 180 days. The legislation on this, initiated by representatives of the government party, was adopted by the parliament yesterday.

The amendment to the law on the coordination of defense and security activities related to the extension of the state of emergency was adopted by the representatives with 142 yes votes, 31 no votes and six abstentions.

According to the legislation effective from November, the authorization can be granted multiple times.

In the justification of the law, it was written that the special legal regulations of several European countries set a time limit for the state of emergency.

Considering this, as well as the fact that it is also possible to take measures limiting fundamental rights during a state of emergency, it is justified to establish a time limit for the extension of the state of emergency by the Parliament - argued the proponents.

Prime Minister Viktor Orbán announced on May 24 that the government is declaring a state of war in Hungary due to the Ukrainian-Russian war. On June 8, the Parliament extended the wartime emergency measures, i.e. the rules created in the special legal order, until November 1.

From the first of November, the rules related to the special legal order of the basic law will also be amended: according to the ninth amendment of the constitution, adopted in December 2020, there will be only three cases of the special legal order: martial law, state of emergency and state of emergency.

According to the new constitutional rules, the government can declare a state of emergency for thirty days instead of the current fifteen days in the event of an armed conflict, war situation or humanitarian disaster in a neighboring country, as well as a serious event threatening the security of life and property, as well as in order to prevent their consequences. The recently adopted law established a time limit for the extension of the state of emergency by the Parliament.

With 139 yes votes, 22 no votes and 16 abstentions, the representatives accepted the proposal of the Minister of Justice Judit Varga on the amendment of certain laws related to the declaration of assets related to the control of the use of European Union budget resources.

The law changes the rules of asset declarations according to the rules agreed with the European Commission.

It will again be mandatory for members of the parliament and the family members of the relevant public officials to declare their assets.

According to the rules adopted in the summer, only the change has to be announced to the declarant, the recently adopted legislation restores the obligation to make annual and final asset declarations.

The asset declaration must first be made by January 31, 2023, the obligation to notify changes remains until this date.
