In order to maintain its viability, the state of Tennessee cannot state that a person's gender is based on physical characteristics present at birth. According to the Budget Review Committee of the Tennessee State Assembly, there is a real danger that the legal determination of human gender based on physical characteristics existing at birth would result in the withdrawal of federal funds .

Tennessee Senate Republicans have passed a bill ("House Bill 239 - Senate Bill 1440") defines gender solely as "a person's unchangeable biological sex" Among other things, the legislation also stipulated that the biological status would not be indicated on official documents, such as the driver's license, in the future.

However, this will most likely not happen, because although the bill passed the Senate, it was stalled in the House of Representatives due to possible budgetary effects. According to the budget review committee, there is a great danger that the adoption of the measure - as a result of non-compliance with the socio-political expectations of the Biden administration - would result in the withdrawal of federal funding (for retaliatory purposes), thus making the state and its specific sectors impossible ( e.g. education and healthcare). As you know, federal grants require a non-alternative definition.

Thus, in order to maintain its viability, Tennessee cannot state that a person's gender is based on anatomical and genetic factors and evidence present at birth.

Responding to the Senate's decision, the Human Rights Campaign, one of the leaders of the radical gender lobby, called the Tennessee senators "extreme" and "stigmatizing" in their statement on Monday, who, according to the organization, made their decision "with the intention of abolition."

Notably, the conservative-led state of Tennessee has recently taken several actions against LGBTQ propaganda and gender ideology targeting children. It prohibited health care providers from performing sex reassignment surgeries on young children and from prescribing puberty blockers or hormones to minors. But so-called "drag shows" have also been removed from schools, public parks and places of worship.
