The constitutional lawyer emphasized that the problem is that none of them stand on the ground of reality, since these demonstrations are based on the effective organization of the left, and those who criticize the Hungarian government,
the number of people taking to the streets is not as large as the left tries to show.
The governing law makes an exception for spontaneous and urgent gatherings, which due to the nature of the gathering are not subject to the general notification rules, however, this does not apply to the behavior of the left wing on Monday, where the organizers would have had to notify, so it can be assumed that they intended to avoid notification.
The fact that the organizers did not fulfill their obligations in this regard was an irresponsible and self-righteous step, with which they put the safety of the participants and other peaceful citizens at risk. Presumably, the non-announcement can be considered a politically motivated provocation, with which left-wing politicians and activists wanted to increase press coverage of the event. The demonstrations took place

As for the legal part, the LV of 2018 on the right of assembly. law regulates the assembly rules valid in Hungary. The law clearly states that "anyone who organizes a public meeting in a public area must notify the competent police department - in Budapest, the Budapest Police Headquarters" of the meeting at least three months prior to its holding, and at least 48 hours before the call. The reporting obligation is necessary so that the police can prepare for the event, ensure the public space, the safety of the participants, and, if necessary, notify the relevant organizations and authorities, such as the operator of the public space and the emergency services, he explained. He added that, in addition to the notification obligation, the law also defines many other conditions for the legal holding of meetings. One of those
it is fundamental that the right to assemble only covers peaceful assembly, the assembly cannot violate legislation or public order.
The legislation also emphasizes the obligation to cooperate, according to which "the organizer and leader of the meeting and the police cooperate during the organization and holding of the meeting", and that "everyone exercises their rights in good faith and in accordance with the purpose during the organization and holding of the meeting". The law also names the reasons on the basis of which the authorities can prohibit the holding of an assembly, among these are the protection of the memory of the victims of the National Socialist or Communist regimes, as well as public safety and public order.
Zoltán Lomnici Jr. noted that the left's action on Monday clearly did not meet all legal requirements, including the above obligation of cooperation. Presumably, this also contributed to the fact that the organizers did not comply with their notification obligation, it can be rightly assumed that they originally planned to cause a scandal, rather than holding a peaceful meeting.
