Although Neflix, the best-known and most used American streaming service provider among Hungarians, is also responsible for complying with the provisions of the Child Protection Act, the National Media and Communications Authority (NMHH) and its Media Council can only act in matters under Hungarian jurisdiction. At the same time, in addition to media services under Hungarian jurisdiction, media content harmful to minors can also be checked ex officio and based on a report, which can lead to legal proceedings in the event of a violation.
The provisions of the Media Act do not apply to all on-demand media services available in the Hungarian language and in Hungary, as the scope of the law only covers media service providers based in Hungary - the Communications Directorate of the National Media and Communications Authority (NMHH) answered the Hungarian Nation's question in connection with , whether the relevant part of the Child Protection Act can be held accountable in the case of the American Netflix, which broadcasts a fairy tale featuring LGBTQ characters for preschoolers.
According to the information, since the media service provider operating the on-demand media service called Netflix (HU) is a company registered in the Netherlands, this media service registered abroad - even though it is available in Hungarian and in Hungary - is not covered by the scope of the media law. Accordingly, the problems arising in connection with the service cannot be investigated by the Hungarian authorities on merits - it was recorded, noting that: the media service provider is subject to the law of the country in which its headquarters are located, so Netflix must comply with Dutch regulations, and in case of violation of this, the Commissariaat voor de Media (the Dutch partner authority) is entitled to act.
