The National Election Commission (NVB) imposed fines on several NGOs on Friday, because the NGOs encouraged invalid voting in the child protection referendum.
At its Friday meeting, the NVB considered several objections against NGOs that encouraged invalid voting in the child protection referendum. According to the NVB, the referendum campaign cannot be aimed at encouraging invalid voting, "because it not only stretches but also breaks through the constitutional goal of the direct exercise of power and the legislative will behind it". According to the board, encouraging an invalid vote is therefore considered an abusive exercise of rights.
Based on these, the NVB established
that Amnesty International Hungary, Artemisszió Foundation, Rainbow Mission Foundation, Háttér Társaság, Labrisz Lesbian Association, Hungarian Asexual Community, Hungarian Helsinki Committee, Atlas Lesbian, Gay, Bisexual Transgender and Queer Sports Association, PATENT Against Patriarchy Társasaga Jogvédé Association, we are noÁr! Nonprofit Kft., the Prizma Transgender Association, the Szimpozion Association, the Rainbow Families Foundation, the Society for Freedom Rights and the Transvanilla Transgender Association violated the principle of the exercise of rights in good faith and as intended when they encouraged an invalid vote in the referendum. NVB ordered the violators to pay a fine of HUF 176,400 each. The NVB obliged Amnesty International Hungary to pay an additional HUF 3 million fine during the assessment of another objection for the same reason.
Based on an appeal, the NVB also decided that the Budapest VIII. The vote counting committee operating in polling station No. 53 of the district violated the basic principle of protecting the integrity of the election, as well as the basic principle of the exercise of law in good faith and in accordance with its intended purpose. The petitioners turned to the NVB because one of the members of the vote counting committee, during the verification of personal identity, asked if the voters were asking for a referendum ballot, because "I will not unnecessarily give a ballot to anyone who does not ask for it".
According to the NVB, the question of the member of the vote-counting committee goes beyond the informational activity, it violates the principle of good faith and proper exercise of rights, because the Sszb member ignored the fact that the committee does not hand over the ballot when the voter requests it, but in any case - a request without - hands over.
When assessing an appeal, the NVB also found that it was unlawful for Péter Márki-Zay to wear the blue ribbon during Sunday's voting. According to the commission, the blue ribbon is a campaign tool, its political message can be read from wearing it, but campaign activities cannot be carried out in the polling stations on the day of the vote, therefore, according to the NVB, Péter Márki-Zay violated the rules of campaigning.
The decisions of the NVB are not legally binding, legal remedies against them can be requested from the Court within three days.
