According to a statement published on the AB's website on Wednesday morning, the board classified as unconstitutional and annulled two orders of the Kúria regarding the certification of the referendum question: in the case of Fudan University, an international treaty, and in the case of the job search allowance, a national referendum cannot be held due to the involvement of the budget.

In August of last year, the National Election Commission authenticated the questions submitted by private individuals in two cases, which were approved by the Curia last December.

Against the decisions of the Court, they appealed to the Ab with a constitutional complaint.

In the case of Fudan University, the Ab found that the law requested to be repealed by the referendum question aims to implement the international treaty concluded with the People's Republic of China. However, according to the Basic Law, the change or repeal of the law that implements the fulfillment of the obligations undertaken in the international treaty and is directly related to it is not subject to a referendum. The Ab therefore determined that the question to be put to the referendum falls within the prohibited scope of the Basic Law, so the decision of the Court is against the Basic Law, and therefore it was annulled by the Ab.

In the case of the jobseeker's allowance, a constitutional complaint was also submitted to the Ab, which established that

the question to be put to the referendum falls into a prohibited subject area, as it would substantively and numerically change the central budget and its implementation, thus directly and significantly affecting the law on the country's annual budget. Based on this, the Court's decision is unconstitutional, so it was annulled by the Supreme Court.

Mayor Gergely Karácsony announced last July that he would initiate a referendum on five issues. Two of these were certified by the National Election Commission at the end of August, the one about Fudan University and the job search allowance.
