Háttér Társaság and ILGA Europe filed a complaint because Hungary is the so-called Even 4 years after the Coman judgment, it does not recognize same-sex marriages concluded within the European Union, reads the Háttér Társaság announcement.
As they write, on June 5, 2018, the European Court of Justice ruled in the Coman case, according to which all member states of the European Union are obliged to recognize marriages concluded by persons of the same sex in other EU member states. The Court found that in the context of the directive on the exercise of the right to free movement, the concept of "spouse" is gender-neutral, so it also covers the same-sex spouse of an EU citizen.
The Court recalls that, according to the provisions on the right of EU citizens to free movement and residence, the family members of the EU citizen must be allowed to follow the EU citizen to the Member State of his new place of residence. Pursuant to the judgment, the recognition obligation of the member states exists regardless of whether the given member state provides for same-sex marriage in its national law or not.
Among other things, it can be read:
"It is shocking that the Hungarian government openly goes against the final judgment of the Court of the European Union," commented Tamás Dombos, an employee of Háttér Társaság's legal aid service, on the case. "We trust that the European Commission will not leave the matter at that and initiate breach of duty proceedings against the government due to the Hungarian legal practice that makes life difficult for same-sex couples."
It seems to be a trend in Europe these days to initiate breach of duty proceedings against Hungary. So be it, but let the question be allowed to ask why someone whose same-sex marriage was recognized, who knows where in the Union, wants to live in our small country. Live where they are recognized. And if he is a Hungarian citizen, why did he go abroad to get married? Yes, because the Hungarian laws do not allow this? Then stay where they were harrowed.
It is also interesting that the self-conscious people who call themselves "rights defenders" do not raise their voices because of other discriminations in the EU, only for the rainbow ones. Because I have not yet heard of any such background company objecting to the fact that several countries in Europe have banned the wearing of face coverings in public spaces. In fact, the European Court of Human Rights ruled in 2014 that it does not violate the right to the free exercise of religion if women's clothing covering the face is banned somewhere.
They did the same in France and Austria. In the Netherlands, the penalty is 400 euros, in Belgium 150 euros, if someone is in a public area with a covered face. In several countries, it was suggested that, as a religious symbol, it should at least be banned from state institutions.
Moreover, as is well known, in France, the wearing of all religious symbols was banned in public schools as recently as 2004: the Jewish headdress, the crucifix worn on a necklace and the Muslim headscarf.
How interesting, neither the Jewish, nor the Christian, nor the Muslim advocates made a fuss, while if we had such a decision, which we don't have, they would obviously initiate proceedings immediately.
There have been many labor problems due to wearing the headscarf. In France, a woman was fired for wearing a headscarf at work because of her religion. Then, referring to such and such human rights conventions, fundamental rights charters, they issued a directive that said:
It covers both the public and private spheres and enables member states to take the necessary measures to maintain public safety and order, prevent crime, protect health and protect the rights and freedoms of others in a democratic society.
So, in a democratic society, where the majority are Hungarian people who reject gay marriage, why shouldn't they have the right to take measures that protect their rights and freedom.
Of course, in today's world, it is also unthinkable that the EU institutions, led by the court, make decisions in accordance with the daily trends, especially when it comes to Hungary. They talk about freedom, rights, and democracy, but they don't even know what is growing on the tree, because to them all this means only the set of values they have set up.
