However, the transgender woman did not leave the matter at that and challenged the decision with the help of the Háttér Társaság. In the lawsuit, the government office claimed that the purpose of the age discount called Women 40 is to compensate women for their role in raising children and maintaining family life, but they could not answer why the discount is also available to childless or single women.

In the end, the court ruled that the government office had unlawfully narrowed down the concept of "gender" in the legislation to the gender at birth.

Complying with the court's decision, the government office finally amended the data on the plaintiff's gender in the register, so that Elvira can retire in 2 years, after 40 years of employment.
