Sources in charge of the matter reported to Origo about another twist regarding Angyal Elvira's early retirement pension. Elvira from Fejér County, who was born as a man but has been officially living as a "woman" since 2013, enjoyed the full support of the gender lobby and tried to take advantage of a legal loophole to benefit from the pension benefits for women. As is known, the county government office did not recognize in the first round that Elvira was eligible for the Women 40 program, and she appealed to the court against the decision. The lawyers of Háttér Társaság, also supported by the organizations of György Soros, helped in the trial. The court ruled in favor of Elvira, annulled the original government office decision and ordered the authority to proceed with a new procedure.

The government party representatives did not leave the outrageous court verdict unspoken, Zsolt Semjén and Gergely Gulyás submitted a proposal to amend the law. According to the justification of the proposal, based on the original intention and common sense, there was no doubt until now that the Women 40 preferential pension right belongs to those who have worked as women for 40 years, but it is now considered justified to confirm this again. They added: it is unthinkable even in countries that are foreign to Hungarian regulations and allow gender reassignment almost at will, that an entitlement that recognizes the outstanding role played by women in society could be misused even for those who, in a given case, suddenly feel like a woman after 39 years of employment as a man, they wrote.

According to Origo's sources, this proposal to amend the law may become obsolete due to an official decision. The Hungarian Treasury, which supervises the pension insurance activities of government offices, reviewed the case and annulled the second decision of the government office. This government office decision was already based on the court verdict, the authority recognized Angyal Elvira's Nők 40 eligibility after her entire career. The Treasury, on the other hand, interpreted the rules in such a way that only the years acquired as a "woman" after gender change count.

The official legal interpretation is important because, since a 2020 amendment to the law, in Hungary, the birth gender is entered in the birth registers, and this data cannot be changed in the future either. And men who underwent gender reassignment before 2020 and live as women logically cannot obtain enough eligibility time to be able to use the Women 40 program. In this way, it can be guaranteed that only women can really take advantage of the pension benefits for women, the newspaper wrote.
