Taking advantage of the provisions of the far-left trans law, which guarantees free gender change from the age of sixteen, dozens of men have initiated gender change in Spain in order to escape punishment for domestic violence.

A man from Seville changed his gender to avoid a sentence for domestic violence, lawyer José Antonio Sires, who represents the woman who was physically and psychologically abused by the man for a decade, reported to the regional press. He said that his client broke up with the abuser for good five years ago, but already in 2014, the court imposed several protection measures against the aggressor, who violated them one after the other. Finally, in 2019, he was sentenced to fifteen months in prison.

After several appeals, he was legally ordered to go to prison in September 2023, but it turned out that he applied to change his gender at the registry office one month before the final verdict, taking advantage of the trans law developed by the far-left Unidas Podemos (Together We Can), adopted at the beginning of last year. The new legislation has made it possible for anyone in Spain to initiate a legal gender change from the age of sixteen, all they have to do is fill out a declaration. Neither prior medical nor judicial approval is required to identify as female or male, nor does one have to undertake future surgery or hormone therapy.

The abuser from Seville - just like countless men who have committed a crime or been convicted in the past year and a half - abused the opportunities provided by the law and changed his gender so that his case would not be heard by the court specializing in domestic or sexual violence, but by the general criminal court, so you can avoid a more severe punishment. In addition, the man also submitted an application for clemency without batting an eye through his lawyer, which has not yet been decided. Meanwhile, according to Sires, he harassed and threatened his victim incessantly before and after the gender change, so the aggression did not stop.

He last attacked her in July, threatening her with threats such as "you only have a few days left to live". After what happened, the victim called the emergency services and the police in fear. The patrols went to the scene, where the aggressor told them that she was already a woman because she had officially changed her gender.

said the lawyer, who is also currently representing another gender reassignment case. In it, he tries to put on the gloves against a soldier who also changes gender, who wants to get him to use the women's changing rooms in the barracks.

Since the adoption of the trans law, abuses have practically continued in Spain. Last September, a man who abused his wife asked for clemency after being granted permission to change his gender, claiming that he had become a new person.

In June of this year, an abusive man who was also awaiting sentencing for domestic violence almost reached his goal in the Balearic Islands. In her case, she was lucky that she applied for the gender change late, so the judge did not approve it.

In March, Madrid alerted the Equality Ministry, which remains in the hands of the far left, to six men who were also accused of domestic violence but had requested a gender change at the registry office. Three of them even applied for protection, saying they were the victims in their relationship.

Gaceta writes that at least ten men in Spain have already avoided punishment for domestic violence thanks to the trans law originally created to protect the rights of LGBTQ people. All this while former far-left Equality Minister Irene Montero, the "mother" of the law, claimed that no man can abuse legal loopholes or avoid punishment just because he identifies as a woman.

However, the former head of ministry's claims were not only completely unfounded in this case. Another law developed by him, which was called "only yes means yes", originally would have provided women with greater protection against rapists, but due to its lack of elaboration, instead of punishing the aggressors more severely, they began to release those abusers from prison one by one , who have previously been convicted of domestic violence or violence against women. According to data from March of this year, since last year, more than 1,200 men have had their sentences commuted in some form due to inaccuracies in the law, reports Magyar Nemzet.
