The government decision states that the decision of the Polish Constitutional Court was triggered by the bad practice of the European Union institutions, which does not take into account the principle of the delegation of powers, and by stealthy extension of powers without amending the basic treaties, tries to take away powers from the member states that they have never transferred to the European Union .

The primacy of EU law can only exist in those areas where the European Union has competence, the framework for this is laid down in the basic treaties of the EU, the document states. The decision of the Hungarian government states that the EU institutions are obliged to respect the national identity of the member states, which is an inseparable part of their basic political and constitutional system. In addition to the EU institutions, the law-enforcement bodies of the Member States, especially the constitutional courts and courts, are entitled to examine the scope and limits of the European Union powers, they write. In the resolution signed by Viktor Orbán, the government asks the EU institutions to respect the sovereignty of the member states during their operations.
