Justice Minister Judit Varga responded to yesterday's decision of the Constitutional Court in a post.

As our portal also reported , the Hungarian robed body stated that in a given situation, our country has the right to decide with whom it wants to live together and with whom it does not. The minister commented on the decision as follows:

"The Constitutional Court made an important decision on the migration issue! The Hungarian AB decision is about immigration, nothing else.

The Constitutional Court made it clear that we have the right to refuse to live with others, as those with whom we have shared a common fate for centuries. Migration not only threatens our sovereignty and self-identity, but also carries a violation of our human rights and human dignity.
Hungary remains a committed member of the European Union. Today's ruling of the Constitutional Court made it clear that as long as the EU rules on immigration are not enforced, Hungary has the right to exercise this power. It has the right to adapt the national rules to reality with additional, unique solutions in order to effectively protect its borders.

With the decision of the Constitutional Court, a strong legal fence was built next to the physical border lock.

This debate also pointed to the need to change Brussels' immigration rules. The procedure of the Hungarian Constitutional Court did not cover the examination of the primacy of EU law, nor was it aimed at reviewing the judgment of the Court of the European Union. In February of this year, I appealed to the Constitutional Court on behalf of the Hungarian government in connection with the implementation of the European Union court ruling on the legal border closure. Compliance with the judgment raised a constitutional problem. We sought an answer to the question whether, in the light of the Europe Clause of the Basic Law , Hungary can implement an EU legal obligation that could lead to a foreign citizen staying illegally in the territory of Hungary staying in the territory of the member state for an unspecified period of time, and thus actually harming the population of the country becomes part of.

In terms of migration, the world has changed a lot and European Union rules are unable to follow reality. It is becoming obvious to more and more countries that the current migration legislation does not apply in practice and is therefore unable to protect Europe from illegal immigration. The member states can only rely on their own measures and unique solutions in the situation caused by the extraordinary migration pressure. More and more countries are claiming this right.

Since 2015, Hungary has built an effective system capable of protecting the country by creating a legal and physical border barrier. However, Brussels did not like this and initiated infringement proceedings against us. As a result, in December last year, he ruled that a foreign citizen illegally staying in Hungary cannot be escorted across the border, and instead an asylum or deportation procedure must be conducted. However, in the absence of effective readmission, the practical result of this would be that these illegally staying foreigners would end up staying in our country. The ruling also banned transit zones. Hungary liquidated the transit zones following the decision of the Court of Justice. However, we do not automatically admit migrants, but ask them to submit their asylum applications at the Hungarian embassies of neighboring countries. After all, our neighbors are all considered safe countries, nobody in neighboring countries threatens migrants. This is not good for Brussels either, they are threatening Hungary with fines and punishments!

Migration pressure is not expected to ease in the near future, and Brussels rules, which were created in peacetime, cannot stop illegal immigration. The Hungarian Constitutional Court points the way to how the European rules should be adapted to reality so that they can effectively protect Europe's borders from illegal immigration.
