On behalf of the government, the Minister of Justice turned to the Constitutional Court and asked the body to interpret the relevant passages of the Basic Law. In its decision published today, the court states that, in addition to incomplete EU regulations, and in accordance with previous practice, in accordance with the protection of national sovereignty, Hungary is "entitled to exercise non-exclusive EU powers".

Based on the interpretation of the Europe clause of the Basic Law, the Constitutional Court found that if the enforcement of joint powers with the Union is incomplete, Hungary is entitled to exercise the given, non-exclusive EU powers, in accordance with the presumption of reserved sovereignty, until the institutions of the European Union do the necessary for the effective enforcement of joint powers measures. - can be read on the website of the Constitutional Court.
