According to constitutional lawyer Zoltán Lomnici Jr., the pseudo-civilian Soros organizations deliberately wanted to discredit and devalue a legal institution that is one of the most sacred achievements of the regime change.

As we reported, several NGOs were fined by the National Election Commission (NVB) on Friday for encouraging invalid voting in the child protection referendum. The panel stated: the referendum campaign cannot be aimed at encouraging invalid voting, because it not only stretches but also breaks the constitutional goal of the direct exercise of power and the legislative will behind it, and is therefore considered an abusive exercise of rights.

According to NVB's decision, Nonprofit Kft., the Prizma Transgender Association, the Szimpozion Egyesület, the Szivárnýcsáldokért Foundation, the Society for Freedom Rights and the Transvanil-la Transgender Association violated the principle of good faith and proper exercise of the law, and therefore ordered them to pay a fine of HUF 176,400 each. Amnesty was fined an additional three million forints during the assessment of another objection for the same reason. The organizations have indicated that they will challenge the decision at the Court.

In response to Magyar Hírlap's inquiry, junior constitutional lawyer Zoltán Lomnici explained: it is a basic constitutional principle that the people are the holders of power, and part of the democratic exercise of power is that citizens can participate in the decision of the most important matters affecting the country's fate directly, also through referendums. The referendum is the strongest form of democratic exercise of power, the clearest way to express the will of the electorate. By its very nature, the purpose of a referendum must always be to be valid and effective, and based on the decision made through it, the bodies with powers and competences can decide what obligations they are under, i.e. what is the demand of society in their direction.

Nevertheless, in connection with the child protection referendum held on April 3, a number of pseudo-civilian organizations associated with György Soros, who espouse the idea of ​​an open society and LGBTQ propaganda, encouraged an invalid vote, which, translated into the language of the law, meant that these groups openly and unequivocally encouraged citizens to behave in bad faith, that is, to go against one of the inviolable basic principles of law, the principle of good faith and fair exercise of law, the constitutional lawyer pointed out.

He stated: with this abusive exercise of rights, the aforementioned organizations violated the constitutional principle of popular sovereignty as well as the constitutional goal of the direct exercise of power, and in the end they consciously wanted to discredit and invalidate a legal institution that is one of the most sacred achievements of the system change.

The NVB previously established that an invalid vote is an illegal vote, it goes against the purpose of the referendum and the provisions of the election law, and the incitement to such a vote is therefore an illegal activity, pointed out Lomnici. He noted: what counts as bad faith and improper exercise of law is examined separately by the Court as a judicial forum in election cases in the light of the specific case.
