The result of the parliamentary election on April 3 became legally binding after the Kúria rejected a single legal remedy request submitted by Mi Hazánk Mozgalom against the decision establishing the national list result of the election on Saturday, MTI reported.

The results of the individual constituencies of the April 3 election became legally binding everywhere by April 12, and the National Electoral Commission - after all the minutes were at its disposal - determined the national list results on Thursday, i.e. how many mandates each national list is entitled to and how many national which candidates obtained mandates from the lists.

It was mentioned that a legal remedy could be submitted against the NVB's decision within one day, and the only review request was judged by the Court on Saturday. The Mi Hazánk Mozgalom requested in its revision request that the court change the NVB's decision and order a recount of the postal votes of voters without a Hungarian address. He referred to the fact that the National Electoral Office (NVI), which counts postal votes, must make public not only the minutes establishing the results, but also all the data at its disposal, with at least daily updates.

According to the Court , the request for review is not thorough, the result of the national list voting is a summary of the partial results that have already become legally binding, therefore its individual parts can no longer be contested by themselves, they can only be challenged on the basis of violations committed during the aggregation of the vote numbers or the allocation of mandates.

The Supreme Judicial Forum drew attention to the fact that, in the party's request for review, the party requested to change the NVB decision by requiring the Court to oblige the NVI to fulfill its obligations related to the counting of votes and the publication of the data underlying the election results. - However, the Election Procedures Act contains an independent legal remedy for what was indicated as the reason for the review request - the illegality of the NVI procedure - which the applicant did not exhaust, the Court added.

The court emphasized: when determining the national list results related to the 2022 election of members of the National Assembly, the procedure of the NVI and the NVB and the separate legal remedies cannot be confused. For this reason, the Court could not even examine the validity of the applicant's presentation regarding the activities of the NVI.

Based on these, the court upheld the NVB's decision. The decision of the Court is final. The NVB's decision establishing the national list result therefore became legally binding. This also means that all decisions related to the determination of the results have become legally binding, i.e. the legally binding final result of the election has been established.
