The recent verdict of the Veszprém Court, according to which transgender people are also entitled to the preferential retirement program, Women's 40, is a gross provocation.

Gabriella Selmeczi, deputy faction leader of Fidesz, recalled: at that time, the "Women 40" was introduced to express respect and appreciation for women. He reminded that this proposal was submitted by Prime Minister Viktor Orbán to the Fidesz-KDNP faction alliance, which supported it.

He added: it can be clearly deduced from the Basic Law that in Hungary there is no "social gender" according to the law, there is "biological gender". This means that whatever gender a person is born as, male or female, this personal data is included in the birth certificate and the legislation must be interpreted based on this, he explained. That is why the court verdict, this "attitude" is outrageous, he noted.

A statement issued by a spokesperson for the European Commission states that although member states must ensure that their laws comply with their obligations in, for example, the European Convention on Human Rights, the conditions and procedures for legal gender recognition are outside the competence of the European Union.

"What is said by the liberal side and the left is not true, that is, that we are violating some kind of human right or European Union right," stressed Selmeczi, adding that the spokesperson of the committee confirmed this by saying that the legal recognition of gender is outside the scope of the European Union under its jurisdiction, i.e. it falls under national competence.

And in Hungary, the government of Fidesz-KDNP, Viktor Orbán, the parliament also decided on this issue, he noted.

Gabriella Selmeczi said: many people called her about the matter, saying that if someone was born as a man, lived his life as a man, and a few years ago underwent an operation to transform himself into a woman, on what basis is he requesting the "Women 40" discounted but full pension. The Fidesz politician said that there is no moral or legal basis to ask for this.

He reminded of the cases when, in his words, female athletes were outraged during the Olympics and World Championships, with full right, because the transgender athletes easily defeated the female athletes competing in the women's field due to their biological characteristics.

If someone is born a man, he is not entitled to "Women 40", he pointed out. To be eligible, one must be born a woman and have 40 years of service, he said. This means that if someone has worked for 40 years, including the years spent raising children, they are entitled to this full-value pension, he explained.

Gabriella Selmeczi said that parliamentarians and legislators should carefully examine whether there is a need to amend the law. Two members of the ruling party - Deputy Prime Minister Zsolt Semjén and Minister Gergely Gulyás - have already submitted a proposal to the parliament.

The task of the Fidesz-KDNP politicians is now to check "very carefully and calmly" whether there are legal loopholes in the current regulations, and if so, how they can be closed.

According to the deputy faction leader of Fidesz, "the majority of society is outraged by these judicial decisions". He added: Hungary has democracy, freedom of speech, freedom of assembly, and everyone lives their life the way they want.

As a woman and as a legislator, she says that she respects and must respect how someone lives their life, what their sexual habits are, but there are laws and social expectations, and these must be followed. Social expectations are also very important when creating laws or when a judge judges, he pointed out.

Gabriella Selmeczi emphasized that children's rights must be respected, as well as parents' rights, how they raise their children. No one should discriminate against Fidesz and KDNP representatives because the "Women 40" was introduced for biological women, and they want to honor women with this law, he declared.
