The former MSZP mayor was under criminal proceedings for fifteen years, when a few days ago the Court annulled all the verdicts that had convicted him and declared that a series of violations of the law had occurred. In the meantime, he received his doctorate and is now Dr. The retrial procedure against a former politician registered as György Hunwald was terminated. There is no possibility of appeal against the decision, so it is final, reports Magyar Nemzet .

the previous convictions of the former politician were annulled, and the retrial procedure was terminated.
The Supreme Judicial Forum ruled that in the case, the prosecution actually made a motion that circumvented the legal rules of retrial. As reported, the requirement of a one-time procedure was violated by the fact that a final acquittal and later a new, final conviction were based on the same facts. "The Court cannot waive this, if it waived it, it would itself be a party to judging a case twice, as was done by the courts involved," they reasoned.
The Court also found that according to the Criminal Procedure Act, the court judges on the basis of the accusation, and that Hunwald's criminal liability was established in the absence of an accusation.
Although the Court did not say that the former mayor of Erzsébetváros is not guilty, Hunwald himself argues that only illegal findings can be made in illegal proceedings, i.e. he does not consider himself guilty.
The ex-politician summed up the conclusion on his Facebook page as follows: "According to my review motion, my criminal convictions, which were made as a result of the prosecutor's retrial in 2016, were annulled, and the retrial procedure initiated against me at the prosecutor's motion was terminated . For seven years, I told three courts, eight judges and two prosecutors in vain and repeated over and over again that illegal proceedings were being conducted against me, but they understood nothing. They took seven years out of my life.”
Antecedent
The mayor of Erzsébetváros was detained in February 2009 and then placed in pretrial detention. In November 2010, in connection with the real estate Panama in Erzsébetváros, charges were brought against him for misappropriation. The charges include a variety of crimes, from fraud of hundreds of millions to the removal of wheel clamps. According to the prosecution, the Hunwalds worked in a criminal organization.
Over the years, several, even contradictory, judgments have been made in the case. Hunwald was last convicted in a retrial on January 13, 2020, and was sentenced to a term of imprisonment to be served. The prosecutor's office initiated the retrial in 2016 and requested the conviction of the socialist politician due to commissions and employment contracts dating back more than ten years.
With the right to the last word, Hunwald denied committing the crimes charged against him, as he said, in connection with the abuses that occurred during his mayorship, he was only an observer of what happened, he did not actively participate in the frauds.
According to the prosecution, György Hunwald is the VII. as the MSZP mayor of the district, he signed fake contracts with his acquaintances and friends, after which no performance or work was carried out, and with this they caused forty-five million HUF damage to Erzsébetváros. According to the indictment, there was a contract holder who received HUF two hundred thousand per month, but during the criminal proceedings he could not tell what his job was. Because of this and other minor crimes, the prosecutor's office asked for a three-year prison sentence, which would have meant a one-and-a-half-year prison sentence for Hunwald.
The Court has now annulled this judgment as well.
